Terms of Use

These Terms of Use (the “Terms”) govern your use of the Tzel iOS app and any related services (together, “Tzel” or the “App”). By downloading, installing or using Tzel, you agree to these Terms. If you do not agree, please do not use the App.

01 Licence to use Tzel

Tzel grants you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use the App on any Apple device that you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms. This licence is for your own personal, non-commercial use.

You agree not to, and not to allow others to:

• copy, modify, reverse-engineer, decompile or create derivative works of the App, except where permitted by law;
• rent, lease, sell, sublicense or otherwise commercially exploit the App;
• use the App in a way that is unlawful, harmful, or that interferes with its operation or other users; or
• remove or obscure any proprietary notices in the App.

02 Tzel Pro subscriptions

Tzel is free to download and use. Some features are offered through an optional auto-renewing subscription, Tzel Pro. If you subscribe:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price for the applicable plan.
• You can manage or cancel your subscription in your device’s App Store → Account → Subscriptions settings.

All purchases, billing, refunds and cancellations are handled by Apple under the App Store terms. We do not process payments or store your payment details. Any refund requests are subject to Apple’s policies.

03 Routing and shade are approximate

Tzel estimates shade, sun, UV, heat and “feels-like” conditions and suggests walking routes using third-party map, building, tree and weather data. This information is provided for general guidance only and may be incomplete, delayed or inaccurate. Shade coverage, shadows and conditions change with the weather, the season, construction, and other factors outside our control.

You are responsible for your own safety. Always use your own judgement, stay aware of your surroundings, and obey all local traffic signals, road rules and signage. Do not rely on Tzel for navigation in a way that distracts you from walking safely, and do not use the App while it is unsafe to do so. Tzel is a walking aid, not a substitute for your attention or for sun-safety precautions such as sunscreen, water and appropriate clothing.

04 Your account and data

You may use Tzel without an account. If you choose to sign in, you are responsible for activity that occurs under your account. Our handling of your information is described in our Privacy Policy, which forms part of these Terms.

05 Intellectual property

The App, including its name, logo, design, text and software, is owned by Tzel and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in the App other than the limited licence described above. Map and weather data remain the property of their respective providers and are used under their terms.

06 Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that conditions and routes will be accurate or available for any particular area.

07 Limitation of liability

To the maximum extent permitted by law, Tzel and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss arising from your use of, or inability to use, the App — including any decision made based on shade, route or weather information. Nothing in these Terms limits liability that cannot be limited by law.

08 Changes to the App and Terms

We may update, change or discontinue features of the App at any time. We may also update these Terms as Tzel evolves; material changes will be reflected here with a new “last updated” date. Your continued use of the App after changes take effect means you accept the revised Terms.

09 Apple as a third-party beneficiary

These Terms are between you and Tzel, not with Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, to the extent applicable. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
